25.6 Contractor Performance Evaluation Report

PURPOSE

Ordinance No. 173018, titled the Contractor Responsibility Ordinance, amended Article 13, Chapter 1, Division 10 of the Los Angeles Administrative Code by adding a requirement for a City Contractor Performance Evaluation Program. This became effective on February 5, 2000. The purpose of this Chapter is to explain the requirements of the Contractor Performance Evaluation Program.

RESPONSIBILITIES

  • Project Manager (PM): The PM is responsible for ensuring that the Contractor Performance Evaluation Report (CPER) is completed and submitted to the Bureau of Contract Administration (BCA), Special Research and Investigation Section within fifteen (15) days of final Field Acceptance (FA) of the construction contract.

  • Construction Manager (CM): The CM is responsible for completing the Bureau of Engineering’s (BOE’s) portion of the CPER and submitting it to the BCA.

  • Bureau of Contract Administration (BCA): The Lead Inspector (LI) is responsible for completing BCA’s portion of the CPER and submitting it to the BCA. BCA is responsible for the maintenance of the Contractor Performance Evaluation Database.

PROCEDURE

The Contractor Performance Evaluation Program is designed to ensure that contractors are evaluated regularly using approved reports and criteria. The evaluative data is cataloged and made available for consideration by all contract awarding authorities in determining a particular contractor's fitness to perform work in the City. Under this program, both BOE and BCA are required to prepare Contractor Performance Evaluation Reports (CPERs) (Attachment 25.6-1 and Attachment 25.6-2) at the conclusion of construction. One CPER is prepared by the BOE CM and another by the BCA LI. Both forms are to be submitted to the Special Research and Investigation Section of the BCA within twenty (20) days of final Field Acceptance (FA) of the construction contract. 

BCA has developed the rules and regulations to be followed by the contract awarding authorities in evaluating, documenting, and reporting on the contractor's performance for construction contracts. The CM is responsible for the timely submission of BOE’s portion of the CPER to BCA. The CPER is to be submitted to BCA within twenty (20) days of the FA date. Both the BOE and BCA CPERs must be on file with BCA prior to the request for project acceptance by the Board of Public Works (BPW). The BPW has deemed that no project shall be placed on the Board Agenda for acceptance, nor will any project be accepted by the Board, until such time as all CPERs have been received by BCA.
