RESPONSIBILITIES
Project Manager (PM), Project Engineer (PE), and Construction Manager (CM): The General Conditions are a fixed document. As such, the responsibilities of the PM, PE, and CM are limited to implementing the most current document. The PM, PE, and CM may submit any recommendations and proposed changes to the Engineer of Design.
City Attorney’s Office: The City Attorney’s Office is responsible for reviewing and approving any requested changes to the General Conditions.
PROCEDURE
The GCs are a mandatory element of the Master Specifications. They represent the manner in which the Bureau administers all construction projects. The GCs define the overall legal framework by which the construction contract will be administered.
Since the GCs affect the legal and contractual relationship of the parties, they were developed with the cooperation of the City Attorney’s Office. The Engineer of Design periodically forwards proposed changes and modifications for review to the City Attorney’s Office. Since this process often requires several months, proposed GC modifications are generally available only for future projects and not the project at hand.
The Master Specification GCs document posted at the BOE website supersedes all other versions of General Conditions. The Master Specification GCs are required to be used for all Bureau construction contracts. Any changes to any article in the GCs must have the prior approval of the City Attorney’s Office. All requests for change must be made to the Engineer of Design.
